Some initial challenges were effective and succeeded in delivering better contracts and unseating undemocratic leaders. Kopieren von Musikdateien ('File-Sharing') via Internet oder CD-Brenner aufmerksam. In der Tat sehen sich die Musikunternehmen seit Ende der 90er Jahre des letzten Jahrhunderts mit einem globalen R?ckgang der Verkaufszahlen auf dem Tontr?germarkt konfrontiert. Als Hauptursache hierf?r sieht die Branche die Konkurrenz durch illegale 'Musik-Piraterie' in Form der im Juni 1999 entstandenen Online-Musiktauschb?rse 'Napster' und ihrer zahlreichen Nachfolger. Diese haben - so die Argumentation - einen negativen Effekt auf den legalen CD-Absatz und w?rden somit zehntausende Arbeitspl?tze in der gesamten Musikbranche und sogar die Zukunft der Musik selbst gef?hrden (vgl. Die deutschen Phonoverb?nde 2004a sowie Oberholzer und Strumpf 2004, S. 2 mit weiteren Nachweisen). Diese Auffassung wird auch von Teilen des wissenschaftlichen Schrifttums zu diesem Thema unterst?tzt. Dagegen machen einige Autoren andere Gr?nde wie bspw. die volkswirtschaftliche Entwicklung der letzten Jahre oder das ver?nderte Konsumverhalten der Wirtschaftssubjekte f?r die Krise in der Musikindustrie verantwortlich. Inwieweit die jeweiligen Argumente in diesem Kontext als relevant betrachtet werden k?nnen und ob die Untersuchungsergebnisse einem Vergleich mit empirischen Daten standhalten, soll im Rahmen dieser Arbeit er?rtert werden. Dazu werden in Kapitel 2 die Konzepte des File-Sharing und der Peer-to-Peer-Netzwerke vorgestellt und eine kurze juristische Beurteilung der Thematik vorgenommen. Daran ankn?pfend wird in Kapitel 3 die derzeitige Krise in der Musikindustrie anhand entsprechender Zahlen dokumentiert und dargelegt, mit welchen Mitteln die Musikwirtschaft auf ihre derzeit schwierige Situation reagiert.
