<p><em>The New Rhetoric</em> is founded on the idea that since “argumentation aims at securing the adherence of those to whom it is addressed, it is, in its entirety, relative to the audience to be influenced,” says Cha?m Perelman and L. Olbrechts-Tyteca, and they rely, in particular, for their theory of argumentation on the twin concepts of universal and particular audiences: while every argument is directed to a specific individual or group, the orator decides what information and what approaches will achieve the greatest adherence according to an ideal audience. This ideal, Perelman explains, can be embodied, for example, "in God, in all reasonable and competent men, in the man deliberating or in an elite.” Like particular audiences, then, the universal audience is never fixed or absolute but depends on the orator, the content and goals of the argument, and the particular audience to whom the argument is addressed. These considerations determine what information constitutes "facts" and "reasonableness" and thus help to determine the universal audience that, in turn, shapes the orator's approach.</p> <p>The adherence of an audience is also determined by the orator's use of values, a further key concept of the New Rhetoric. Perelman's treatment of value and his view of epideictic rhetoric sets his approach apart from that of the ancients and of Aristotle in particular. Aristotle's division of rhetoric into three genres?forensic, deliberative, and epideictic?is largely motivated by the judgments required for each: forensic or legal arguments require verdicts on past action, deliberative or political rhetoric seeks judgment on future action, and epideictic or ceremonial rhetoric concerns values associated with praise or blame and seeks no specific decisions. For Aristotle, the epideictic genre was of limited importance in the civic realm since it did not concern facts or policies. Perelman, in contrast, believes not only that epideictic rhetoric warrants more attention, but that the values normally limited to that genre are in fact central to all argumentation. <p>Virginians dominate the early history of the United States, with Washington, Jefferson, Madison, Monroe, Patrick Henry, George Mason, George Wythe, and John Marshall figuring prominently in that narrative. Fellow Virginian Spencer Roane (1762?1822), an influential jurist and political thinker, was in many ways their equal. Roane is nonetheless mostly absent in accounts of early America. The lack of interest in Roane is remarkable since he was the philosophical leader of the Jeffersonians, architect of states’ rights doctrine, a legislator, essayist, and, for twenty-seven years, justice of the Virginia Supreme Court. He was the son-in-law of Henry, a confidant of Jefferson, founder of the influential <em>Richmond Enquirer,</em> and head of the “Richmond Junto.”</p> <p>Roane’s opinions established judicial review of legislative acts ten years before Supreme Court Chief Justice Marshall did the same in <em>Marbury v. Madison.</em> Roane also brought down Virginia’s state-sponsored church. His descent into historical twilight is even more curious given his fierce criticismーboth from the bench and in the <em>Richmond Enquirer</em>ーof Marshall’s nationalistic decisions. Indeed, the debate between these two judges is perhaps the most comprehensive discussion of federalism outside of the arguments that raged over the ratification of the United States Constitution.</p> <p>In <em>Irreconcilable Founders,</em> David Johnson uses Roane’s long-lasting conflict with Marshall as ballast for the first-ever biography of this highly influential but largely forgotten justice and political theorist. A courageous, indefatigable, and superbly intelligent young man, McClellan formed close personal loyalties in those years. <p>One of the most important, and controversial, Confederate generals during the Civil War was Lieutenant General James Longstreet, the man Robert E. Lee called his “old war horse.” Longstreet was Lee’s principal subordinate for most of the war, ably managing a corps in the Army of Northern Virginia and being instrumental in Confederate victories at Second Bull Run, Fredericksburg, and Chickamauga. Longstreet was also effective at Antietam and the Battle of the Wilderness, where he was nearly killed by a shot through the neck.</p> <p>Had Longstreet died on the field in early May 1864, he would almost certainly be considered one of the South’s biggest heroes. However, it was his performance at Gettysburg and arguments with other Southern generals after the Civil War that tarnished his image. After the South lost the war and Gettysburg came to be viewed as one of its biggest turning points, former Confederate generals looked to that battle to find scapegoats to blame for losing the war. Longstreet was charged with being slow to attack on the second day of the Battle of Gettysburg, allowing the Union to man Little Round Top. He also resisted Lee’s order for Pickett’s Charge the next day, making his criticisms clear both that day and after the war through his rightings. The fact that he served in Republican administrations after the Civil War rubbed his former comrades the wrong way, and the Georgian Longstreet’s criticism of Lee infuriated the Virginian Lost Cause advocates who idolized Lee.</p> <p>Near the end of his life, Longstreet authored <em>From Manassas to Appomattox</em>, a Civil War memoirs that looked to rebut his critics. Longstreet didn’t avoid his critics, facing them head on by fending off criticisms of his record for the most part, usually including letters written by other officers to his defense. Longstreet also didn’t pull punches, which he does at times quite poignantly on Lee's mishaps, most notably of course at Gettysburg. In other instances, he defends himself by criticizing others. When Fitz Lee notes that R.E. Lee called Longstreet the hardest man to move in the Army (a comment that can't be confirmed or refuted), he comes to his own defense in part by criticizing Stonewall Jackson during the Seven Days campaign. Hindsight is 20/20, and Longstreet's arguments in the conduct of certain campaigns certainly benefited from the passing of 30 years. At a number of places, Longstreet believes that if his suggestions were followed, the results could have destroyed Union armies or won the War. And as a top graduate of West Point, Lee had distinguished himself so well before the Civil War that President Lincoln asked him to command the entire Union Army. Lee famously declined, serving his home state of Virginia instead after it seceded.</p> <p>Lee is remembered today for constantly defeating the Union’s Army of the Potomac in the Eastern theater from 1862-1865, considerably frustrating Lincoln and his generals. His leadership of his army led to him being deified after the war by some of his former subordinates, especially Virginians, and he came to personify the Lost Cause’s ideal Southern soldier. His reputation was secured in the decades after the war as a general who brilliantly led his men to amazing victories against all odds.</p> <p>Thomas Jonathan Jackson is one of the most famous generals of the Civil War, but many of the people he continues to fascinate probably don’t remember his whole name. That’s because Jackson earned his famous “Stonewall” moniker at the First Battle of Manassas or Bull Run, when Brigadier-General Bee told his brigade to rally behind Jackson, whose men were standing like a stone wall. Ironically, it’s still unclear whether that was a compliment for standing strong or an insult for not moving his brigade, but the nickname stuck for the brigade and the general itself.</p> <p>Jackson would only enhance his legend over the next two years, first leading his army on one of the most incredible campaigns of the war in the Shenandoah Valley in 1862.. Known as the Valley Campaign, Jackson kept 3 Union armies occupied north of Richmond with less than 1/3 of the men, marching his army up and down the Valley 650 miles in three months.
