Jahrhunderts am RG anh?ngig war, gr?ndete urspr?nglich auf internen Streitigkeiten der einzelnen Kartellmitglieder. Zur Beurteilung der Klagebegehren bed?rfte es jedoch auch der Frage nach der Rechtm??igkeit von Kartellen im Allgemeinen. So wurde das am 4. Februar 1897 verk?ndete Urteil zu einer Leitsatzentscheidung seiner Zeit. Aus den Gr?nden ging hervor, dass man Kartelle nahezu unbeschr?nkt zulassen wolle. Dadurch wurde die ohnehin verh?ltnism??ig fortgeschrittene Kartellierung der deutschen M?rkte weiter angetrieben. Deutschland entwickelte sich zum so genannten 'Land der Kartelle'. Im Jahre 1911 sch?tzte man die Zahl der Kartelle auf etwa 550-600, 1923 sogar auf rund 1500. Angelangt im 21. Jahrhundert, wird diese h?chstrichterliche Entscheidung h?ufig als warnendes Beispiel einer hinter uns liegenden Fehlentwicklung empfunden. Kartelle werden gemeinhin als die Feinde der Privatautonomie gesehen und man bem?ht sich ihre einschr?nkende Wirkung zu begrenzen. Hatte sich das RG, als es 1897 Kartelle ausdr?cklich bef?rwortete, damit unweigerlich gegen die Privatautonomie entscheiden wollen? Zur Beantwortung dieser Frage reicht die reine Erfassung der abgedruckten Urteilsbegr?ndung nicht aus. Vielmehr soll in der vorliegenden Arbeit versucht werden, die Beurteilung der Richter im Lichte der zeitgen?ssischen Einfl?sse zu verstehen. Weshalb f?llte der VI. Zivilsenat des RG dieses Urteil so, wie es am 4. Februar 1897 ergangen ist? Stellte es tats?chlich die Privatautonomie versus Kartelle und entschied sich f?r letztere? Am 22. M?rz 1893 gr?ndeten mehrere Firmen, die im K?nigreich Sachsen wei?en Holzstoff fabrizierten, den 'S?chsischen Holzstoff-Fabrikanten-Verband'. Hintergrund des Zusammenschlusses war das Bestreben, den Preis f?r s?chsischen Holzstoff k?nstlich auf einem h?heren Level zu halten. Im Statut hie? es, dass der Zweck des Verbandes sei, 'in Zukunft einen verderblichen Wettbewerb der Fabrikanten untereinander zu verhindern und f?r ihr Fabrikat ei-nen angemessenen Preis zu erzielen'. Daf?r sollte eine gemeinsame Verkaufsstelle errichtet werden, ?ber welche die Produkte der beteiligten Firmen w?hrend der Vertragslaufzeit ausschlie?lich verkauft werden d?rften. The French were far less enthusiastic. Political and scientific ?lites in France struggled with the “reality” of statistical populations, wrestling with concerns about the accuracy of figures that aggregated heterogeneous groups such as the rich and poor and rejecting probabilistic interpretations.＜/p＞ ＜p＞Tracing the introduction and promotion of vital statistics and demography, Schweber identifies the institutional conditions that account for the contrasting styles of reasoning. She shows that the different reactions to statistics stemmed from different criteria for what counted as scientific knowledge. The French wanted certain knowledge, a one-to-one correspondence between observations and numbers. The English adopted an instrumental approach, using the numbers to influence public opinion and evaluate and justify legislation.＜/p＞ ＜p＞Schweber recounts numerous attempts by vital statisticians and demographers to have their work recognized as legitimate scientific pursuits. While the British scientists had greater access to government policy makers, and were able to influence policy in a way that their French counterparts were not, ultimately neither the vital statisticians nor the demographers were able to institutionalize their endeavors.
