Jahrhunderts, Note: 2,0, FernUniversit?t Hagen (Institut f?r Philosophie), Sprache: Deutsch, Abstract: Die Arbeit setzt sich kritisch mit dem von Leibniz konzipierten dreistufigen Naturrechtssystem auseinander, wie er es bereits ab ca.1667 in seinen fr?hen Schriften, Fragmenten und Briefen dargelegt hat. Zur Erl?uterung dieses Systems soll in einem ersten Schritt nachgezeichnet werden, aus welchen Motiven heraus Leibniz versucht, eine neue Rechtsordnung zu begr?nden. Dazu sind seine verschiedenen Kritikpunkte am bestehenden R?mischen Recht aufzeigen, aber auch darzulegen, was er an diesen ?berlieferten positiven Rechtsnormen bef?rwortet. Als Ergebnis seiner Betrachtungen entsteht f?r Leibniz die Notwendigkeit von Reformen der Rechtswissenschaft. Seiner Konzeption nach geht es darum, die gesamte Jurisprudenz auf ein wissenschaftliches Fundament zu stellen und zu diesem Zweck seine in der kombinatorischen ars inveniendi entwickelte Methode f?r die Rechtskenntnis fruchtbar zu machen. Da Leibniz der Auffassung ist, dass ein gro?er Teil des geltenden R?mischen Rechts nicht im Widerspruch zum Naturrecht steht, zielt er darauf, eben diesen S?tzen des positiven Rechts eine neue Gestalt zu geben und sie mit den Elementen des Naturrechts vereinbar zu setzen. Zur Erl?uterung des Leibniz'schen Naturrechtsbegriffs wird zun?chst seine Auseinandersetzung mit den traditionellen Naturrechtskonzeptionen vorgestellt und aufgezeigt, dass Leibniz die vielf?ltigen und teilweise heterogenen Konzepte seiner Vorg?nger ?ber sein eigenes System miteinander zu vereinbaren sucht. Dabei wendet er sich scharf gegen eine S?kularisierung des Naturrechts und versucht, eine allgemeine Lehre von der nat?rlichen Gerechtigkeit zu entwickeln. Diese Bestimmung der Gerechtigkeit findet er schlie?lich in der 'Liebe der Weisen' (caritas sapientis), die das oberste Prinzip seiner Naturrechtslehre bildet. Das Naturecht hat aber im Verh?ltnis zum positiven Recht nur einen subsidi?ren Geltungscharakter, der sich in der Leibniz'schen Vorstellung einer Regelungshierarchie der Rechtssysteme niederschl?gt.
